San Diego STRA Letter in Response to Upcoming City Council Vote on Whether to Amend the STRO Implementation Date
Dear Councilmembers,
I am reaching out to you on behalf of the San Diego Short-Term Rental Alliance (San Diego STRA), a grassroots organization representing more than 30,000 short-term rental owners, operators, employees and local vendors.
First and foremost, we want to commend you for your consideration of amending the STRO implementation date to allow for a full review from the California Coastal Commission. This is a complicated topic that includes a number of factors that must be taken into consideration. Extending the implementation date to avoid the middle of summer, the peak of travel season, will allow for the necessary time to examine the issue and implement the STRO changes at an appropriate time.
We acknowledge the time you have put in to evaluate this situation and very much support amending the STRO implementation date. In addition to amending the start date, clarity around some remaining questions would be very helpful to the community. Our group has worked together to compile a list of questions that would help ensure responsible hosting and compliance. These questions include:
- How should operators with multiple dwelling units on one parcel apply for each of those units?
- Will that be a different process than that of operators with multiple dwelling units on multiple parcels?
- Can multiple individuals apply for the same permit on the same dwelling unit?
- Can one individual apply for multiple permits on multiple dwelling units?
- Will dwelling units in underlying commercial zones be treated any differently than dwelling units in underlying multifamily residential zones?
- Will dwelling units in underlying single-family residential zones be treated any differently?
- Can one apply for a permit in the name of an LLC, Corporation or Trust?
- Can a person under the age of 18 apply for a permit?
- Will permits be removed from hosts who do not engage in STR activity after obtaining their permit? If so, under what parameters will these be measured?
- After the lottery is complete and permits are issued, will there be a list of applicants who were not issued a license? If so, will these applicants be prioritized for future permits? Will a waiting list be created?
- What census data the city is using to determine the number of households, and how often it will be updated to adjust the number of available licenses?.
- When a license becomes available after the cap is met, how soon does that license pass to the next in line?
We also understand that many of these questions may require additional time and research to provide full responses. If there is any way we can be of assistance we are always available to work together and collaborate with the City to ensure that short term rentals continue to be a time-honored method of visiting San Diego.
